These Terms and Conditions ("Terms") govern your use of the HCMNotify platform, website, and related services provided by CPB3 Tech LLC ("HCMNotify," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

You retain ownership of all data you provide or process through HCMNotify. We process client data solely to provide the services and in accordance with our Privacy Policy. We implement appropriate technical and organizational measures to protect client data.
All content, features, and functionality of the HCMNotify platform — including software, text, graphics, logos, and documentation — are owned by CPB3 Tech LLC and protected by intellectual property laws. You may not copy, modify, or distribute any part of our platform without written consent.
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime or service interruptions beyond our reasonable control.
Fees for HCMNotify services are outlined in your service agreement or subscription plan. All fees are due as specified and are non-refundable unless otherwise stated. We reserve the right to modify pricing with 30 days' notice.
To the maximum extent permitted by law, CPB3 Tech LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the services. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
The services are provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
You agree to indemnify and hold harmless CPB3 Tech LLC, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the services or violation of these Terms.
We may suspend or terminate your access to the services at any time for any reason, including violation of these Terms. Upon termination, your right to use the services ceases immediately. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Arapahoe County, Colorado.
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the services after changes constitutes acceptance of the updated Terms.
